BEST PRACTICE FOR A BETTER CANNABINOID FUTURE

Legal Obligations and
Responsibilities

Whatever opinions we each hold as to the merits of the legal obligations and responsibilities, the law is the law and, in order to foster and secure the long-term prosperity of the whole Cannabinoid industry, that law must be adhered to.

As an active market participant, it is essential that you have an understanding and appreciation of the laws and regulations within your industry. Neither obligation to comply nor liability for breach can be abrogated – you and your business will be held liable for any breaches of your processes and products.

The law and landscape are new and complicated, but with the independent professional advice and assistance of experts, facilitated through The Canna Consultants, it need not be daunting. It is a challenge, but with the knowledge and guidance of The Canna Consultants, it is one that we believe can be met.

We invite all market participants to make contact with us and share in our vision for the future of the market that we all want to see succeed for the long-term, not just the short.

Quality and Control of Ingredients
Processing, Promotion and Validation

In such a fledgling environment, where there are no standardised methodologies, it is essential that you are able to validate the provenance, quality and consistency of your product from seed to shelf. We can assist you in the evaluation and assessment of your supply chains, each of which may be unique on a per-product basis.

  • Do you know who ASTM International are?
  • Do you know who UKAS are?
  • Are you aware of the ISO 17025 requirements?
  • Are you aware whether your suppliers meet them?

In our view, a fully verifiable journey from seed to shelf is the absolute bedrock upon which your entire business is, or should be, based – it is what marks you out against your competitors.

It marks you out, professing your absolute responsibility to your customers and maintaining the highest ethical standards.

We are able to facilitate the provision of a legal Opinion addressing your supply-chain exposure from a self-employed barrister in independent practice, provided directly to you with all of the protections which that provides.

If there is a lack of transparency within your supply chain then, through our relationships and experience within the industry, we are able to facilitate the adaptation of your supply chain so that you, your current customers and your potential future customers can be satisfied with provenance, quality and consistency through effective transparency and traceability.

Clarity and Compliance of Labelling

– Do you know exactly what you can say about a CBD product?

– Do you know exactly what you can never say about a CBD product?

– Do you know the regulatory-specific definitions of the words that you wish to use?

– Do you know what font you are permitted to use?

– Do you know what size font you cannot use?

– Do you know what information should be identified in bold?

– Do you know what certification you need to support any statement made?

– Do you know the surface area of your label, or why it is relevant?

A comprehensive, independent and certified analysis of all of the labelling for your entire product range is essential.

It is part of the predominant information upon which potential customers gain their first impression and make an engagement decision.

Equally, it is the most obvious manifestation of you as a business and the information which most easily presents itself to the enforcement authorities – first impressions can be lasting.

We are able to facilitate the provision of a legal Opinion on your product labelling from a self-employed barrister in independent practice, provided directly to you with all of the protections which that provides.

Manufacturing

Can you answer “Yes” to each of these:

  • Do you know what ISO 9001 is?
  • Do you know what ISO 17025 is?
  • Are you able to comply?
  • Do your suppliers comply?
  • Do you know what the cGMPs are for foodstuffs?
  • Are you able to comply?
  • Do your suppliers comply?

Controlled Drugs

Elements within the industry seek to suggest that it is permissible to have a THC content within your products of less than 0.2% – thus making them “legal” within the UK. That is not a position with which we agree. We believe that the law requires that there must be zero detectable CBN and THC within your CBD products.

Through our contacts and relationships within the industry, we are able to facilitate the testing of your product lines in order to ensure that you are aware of the potential level of your exposure to prosecution under UK criminal drugs legislation.

Promotion and Marketing

The provision of clear, honest and ethical marketing messages, through traditional and contemporary materials should be a cornerstone of your business and practice. Your products are not liable simply to the requirements of the ASA/CAP, but are subject to further scrutiny by industry-specific regulators such as the MHRA.

We are able to facilitate the provision of a legal Opinion on your product marketing from a self-employed barrister in independent practice, provided directly to you with all of the protections which that provides.
